It is a time of great reckoning in United States trademark and unfair competition law. For one thing, the Supreme Court has continued to accept cases bearing on the subject of the Lanham Act at a rate that would have been unthinkable during the comparatively fallow years of the second half of the Twentieth Century. For another, Congress has enacted the Trademark Modernization Act (TMA), one provision of which—the restoration or confirmation of the presumption of irreparable harm upon a violation of the Lanham Act—apparently became effective on December 27, 2020, a year in advance of the remainder of the TMA.
